Terms

Terms

Draft for studio and legal review · 22 October 2026 These terms apply to use of the CS Art Studio website. The studio is located in Pretoria, South Africa. Contact enquiries@csartstudio.co.za or WhatsApp +27 82 470 3161. This draft does not replace the terms agreed for a particular purchase.

Enquiries and purchases

The website displays original artwork, prints, sculpture, functional art and creative services. It accepts enquiries, not online checkout payments. Sending an enquiry or using an Order Print button does not itself conclude a sale or reserve an item. Availability, dimensions, materials, price, any taxes, delivery costs, payment arrangements and completion dates must be confirmed directly with the studio before you agree to purchase. Screen colours may differ from the actual work; please confirm important details before purchasing. Courier delivery worldwide is available by arrangement, subject to destination and an agreed quotation. Any applicable customs charges, delivery conditions and risks must be disclosed and agreed before purchase.

Your consumer rights

Nothing in these terms limits rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), or other applicable law. Where the CPA applies, goods must meet its applicable quality and suitability standards. Qualifying defective goods may be returned within six months of delivery for the statutory repair, replacement or refund remedy, subject to the Act's conditions. Custom-made goods do not lose applicable defective-goods protections simply because they were commissioned. Where ECTA section 44 applies to an electronic transaction, a consumer may cancel a qualifying goods transaction within seven days after receipt without reason or penalty, except the direct cost of returning the goods. Applicable refunds must be made within 30 days of cancellation. Statutory exceptions include certain goods made to the consumer's specifications or clearly personalised; these exceptions do not remove other applicable rights. Do not assume every artwork or print is exempt. Any specific cancellation and returns arrangements must be confirmed before the transaction, without overriding statutory rights.

Artwork, website use and disputes

Copyright in artworks, photographs, designs and website materials remains with the relevant rights holder unless agreed otherwise in writing. Buying an artwork does not itself transfer reproduction rights. Do not reproduce or commercially exploit the materials without permission or another lawful basis. Do not misuse the website, attempt unauthorised access, or submit unlawful material. South African law governs these website terms, subject to mandatory protections applicable to a particular transaction. Please contact the studio first about a concern. Nothing prevents you from approaching a competent court, consumer authority or other lawful dispute-resolution body. Any liability limitation is subject to applicable law; these terms do not exclude liability that cannot legally be excluded.

Supplier details and legal references

Before sales are concluded electronically, the studio must confirm and provide applicable ECTA section 43 supplier disclosures, including its legal trading identity, physical address and other required particulars. This website currently provides a city and contact details only; this draft is not a complete supplier disclosure statement.
